Conflicts Resolution Analyst

Department:  Conflicts/New Business

Hours:  9:00 a.m. – 5:30 p.m., Monday-Friday (or as assigned pursuant to business requirements) (37.5 hours per week), with evening and weekend overtime, as required

Reports to: Conflict Resolution Supervisor 

Responsibilities

Guided by department objectives and priorities and following guidelines and procedures established by the Firm’s conflict of interest attorneys, assists partners and conflicts attorneys with resolving conflict of interest issues. Proactively communicates with attorneys, Firm senior risk managers, and others regarding conflicts matters. Performs in-depth research, makes recommendations for resolution, and documents new matter, lateral in-take and thrust-upon clearance. Ensures client services and satisfaction are attained in all areas of position.

Essential Functions

New Matter Conflict Resolution and Related Responsibilities

  • Review conflict reports to identify and prioritize potential new matter and lateral intake conflicts issues. Verify completeness and accuracy of subject matter descriptions of the new and conflicting matters. Research Firm databases and other resources to determine the status and nature of potentially conflicting matter and determine waiver requirements.
  • Proactively collaborate with responsible attorneys and others on potentially conflicting matters to obtain any additional information needed and determine the preferred course of resolution.
  • Research corporate relationship of affiliated entities using commercial databases to determine whether corporate separateness can be relied on to resolve a conflict, and to address thrust-upon conflicts.
  • Following guidelines established by the Firm’s conflict of interest attorneys, provide attorneys with recommendations on the steps necessary for them to resolve any identified potential conflicts.
  • Determine the extent to which waivers are required to resolve certain conflicts, and understand client disclosure obligations and limitations.

  • Summarize the conflicts resolution process in writing and in a timely manner.
  • Coordinate with appropriate personnel in C/NB to make database updates and/or create ethical walls, as necessary.
  • Maintain updated profiles and conflicts/waiver understandings of the Firm’s “Simplified Clearance Clients,” and research other clients to determine whether any meet the criteria for Simplified Clearance Client status.
  • Update and maintain conflicts profiles of select clients and adversaries, as requested by Firm management and/or various practice groups.
  • Assist with new matter conflicts analysis, as necessary.

  • Ensure compliance with the Firm’s Information Handling Policy, including safeguarding confidential and personal information, and reporting any suspected breach appropriately and immediately.
  • Adhere to the Firm’s General Safety Practices and any unique safety practices for department and building.

Qualifications

Education and Experience

  • Minimum one year experience as a conflicts analyst. 

Teamwork and Applied Skills

  • Demonstrated excellent communication and interpersonal skills. Ability to communicate comfortably with all levels of personnel and engage in sensitive communications regarding legal and business issues.
  • Strong attention to detail and advanced analytical and problem-solving skills.
  • Ability to respond to requests with appropriate sense of urgency based on business needs.
  • Ability to efficiently and calmly manage multiple work assignments concurrently, including under sometimes stressful conditions.
  • Knowledge of conflicts of interest issues, laws and procedures. Ability to interpret and understand the implications of various waivers, including non-standard waivers.
